Terms of Service

1. Agreement to Terms

By accessing or using FPSHub's website ("Site") and services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services. FPSHub is operated by FPSHub LLC, a veteran-owned business providing PC optimization services and custom gaming hardware solutions.

2. Services Offered

FPSHub provides the following services:

• Remote PC Optimization Services: Including standard optimization, fresh Windows installation with optimization, and all-inclusive bundles
• Custom PC Building: Selection, assembly, and delivery of custom gaming PCs
• Warranty Subscriptions: Extended warranty coverage with priority support (monthly recurring or prepaid packages)
• Same-Day Service: Expedited scheduling for urgent optimization needs (additional $100 fee)
• PC Builder Tool: Interactive component selection and configuration planning

3. User Accounts

To access certain services, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and up-to-date information

You must be at least 18 years old or have parental consent to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our discretion.

4. Remote Service Requirements

For remote optimization services, you agree to:

• Provide remote access to your PC using our approved software (AnyDesk, TeamViewer, or similar)
• Ensure stable internet connectivity during the service session
• Back up your important data before service (we are not responsible for data loss)
• Disable antivirus software temporarily if requested for optimization purposes
• Follow technician instructions during the service

5. FPS Performance Guarantee

Money-Back Guarantee: We guarantee measurable FPS improvement after our optimization services. If you do not experience improved performance, you may request a full refund within 7 days of service completion. To qualify for a refund:

• You must provide before-and-after benchmark data showing no improvement
• Your PC must meet the minimum hardware requirements for your games
• No unauthorized changes were made to your system after our service
• You followed all post-service recommendations

Note: Performance improvements depend on your hardware. We cannot guarantee specific FPS numbers, only that your system will perform better than before our optimization.

6. Warranty Subscriptions

Subscription Types:

• Monthly Recurring: Billed monthly, can be canceled anytime (cancellation takes effect at end of billing period)
• Prepaid Packages: 3, 6, or 12-month packages paid upfront, non-refundable after 7 days

Commitment Requirements: Users who cancel a recurring subscription and return within 6 months must commit to a 6-month subscription before accessing monthly billing again.

What's Covered: Extended warranty, priority support, exclusive Discord access, and periodic re-optimization services. Hardware failures due to normal wear and tear or manufacturer defects are not covered unless explicitly stated in your custom PC build warranty.

7. Payment and Billing

Payment Methods: We accept payments through Stripe, PayPal, and Affirm. By providing payment information, you authorize us to charge your chosen payment method.

Pricing: All prices are in USD and subject to change with notice. Sales tax will be calculated at checkout based on your location.

Recurring Charges: Subscription services automatically renew. You will be charged at the start of each billing period unless you cancel before the renewal date.

Failed Payments: If payment fails, your service may be suspended. You are responsible for maintaining valid payment information.

8. Cancellation and Refunds

Service Cancellations: You may cancel services before work begins for a full refund. Once service has started, cancellations are subject to partial refunds based on work completed.

Subscription Cancellations:

• Monthly recurring subscriptions can be canceled anytime; access continues until period end
• Prepaid subscriptions maintain access until expiration date when canceled
• No refunds for partial months unless service guarantees are not met

Custom PC Builds: Custom hardware orders cannot be canceled once parts have been ordered. A 25% restocking fee applies to cancellations before parts ordering.

9. Intellectual Property

All content on this Site, including text, graphics, logos, software, and optimization techniques, is owned by FPSHub or its licensors and protected by copyright and intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary optimization methods
• Reverse engineer our processes for commercial use
• Use our trademarks without written permission
• Scrape or harvest data from our Site without authorization

10. Limitation of Liability

Service Disclaimer: While we take every precaution, PC optimization carries inherent risks. FPSHub is not liable for:

• Data loss (you must backup your data)
• Hardware failures unrelated to our service
• Third-party software issues
• Incompatibility with future software updates
• Lost revenue, profits, or business opportunities

Maximum Liability: Our total liability shall not exceed the amount you paid for the specific service that gave rise to the claim.

11. Discord Integration

By connecting your Discord account, you grant us permission to:

• Access your Discord user ID, username, and avatar
• Assign server roles based on your subscription status
• Remove roles when subscriptions expire

Discord account linking is optional but required for subscriber-exclusive channels. You can disconnect at any time.

12. Affiliate Program

Our affiliate program allows approved partners to earn commissions on referrals. Affiliates must:

• Disclose their affiliate relationship when promoting FPSHub
• Not use misleading advertising or spam tactics
• Comply with FTC guidelines for affiliate disclosures
• Not bid on FPSHub trademarks in paid search

Commission rates and program terms are subject to change. We reserve the right to terminate affiliate accounts for policy violations.

13. Prohibited Activities

You agree not to:

• Use our services for illegal purposes
• Attempt to gain unauthorized access to our systems
• Upload malware or malicious code
• Harass staff or other users
• Abuse refund policies or chargebacks
• Create multiple accounts to circumvent restrictions
• Resell our services without authorization

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms. Material changes affecting existing subscriptions will be communicated via email.

15. Dispute Resolution

Informal Resolution: If you have a dispute, please contact us first at kibbs@fpshub.org. We'll work in good faith to resolve issues.

Arbitration: Any unresolved disputes shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class-action lawsuits.

Governing Law: These Terms are governed by the laws of the United States, without regard to conflict of law principles.
